Deposits and Payment
At least a 50% deposit is due before any design work or production can begin. The remainder 50% balance is due upon completion. A 50% non-refundable deposit is due, after a quote is issued and approved by you. The balance of the 50% is to be paid at the end of the project, once project is approved and before the final package is delivered/uploaded. Work commences when deposit is received. You can pay your deposit here.
Cancellations and Refunds
You can make cancellations at any time. Please keep in mind that the deposit and any fees for work rendered or designed is non-refundable.
Images & Stock Photos
It’s optional to provide your own images. We work with our own gallery of stock images at no extra charge to you. Fees may apply in specific cases (large quantity requests, special licensing for photos, etc). You will be advised of these fees after consultation of your project.
Search Engines and SEO
Outside of the keywords and basic SEO meta tags we incorporate in your site, we are not responsible for search engine promotion or marketing of any kind.
Our Portfolio and Website Credit
We reserve the right to add completed projects to our portfolio. If a full web design and development project was completed by our company, in most cases a credit “site by Agara Design” will be included at the bottom of your website. In certain cases, our website credit will not be posted due to privacy purposes and we respect that. Please notify us if this is the case.
Copyright for Logo Design
Client will have the exclusive right to the logo design chosen. All logos are made with no stock images, are 100% custom and 100% vector (which means that you can scale to any size without losing quality). Any concepts that are not chosen and paid for will be a violation of Agara Design’s rights if they are used elsewhere.
Copyright for Web Design
Web designs are custom-created and exclusive to each business. Note that we reserve the right to use stock images, as required, as part of your web design template. Any concepts that are not chosen and paid for will be a violation of Agara Design’s rights if they are used elsewhere.
Small revisions can be made after we provide the initial mockup. We allow three rounds of small revisions, after that, we will bill per additional round. We try to get as much information from you as possible to get the first mockup correct. We want you to be happy with your order, but we also need you to understand that our time and expertise is valuable. We ask that ALL edits/revisions are requested at the same time. Edits/Revisions also need to be in line with the original order, a complete revamp or new idea will be considered a new job.
Website Content From You
Upon each website project we begin, a web design questionnaire is given to the client to fill out to help the project run more smoothly. WE ASK THAT ALL WEBSITE CONTENT IS GIVEN before we start the coding stage of your website. This not only helps firm up an accurate and well laid out design mockup, but it helps to speed up the process as well and get your website launched. We are not responsible for proof-reading your content, so please make sure there are no errors when sending it over.
A project will be considered abandoned if we have not heard from you in 30 days. We do our best to get in-touch with you and wrap up the project as quickly as possible. You will not have any rights to use any of the work that was presented to you, unless you contact us and pay the rest of the project in full.
If we have not heard from you and you contact us after the 30 days and your project has been marked abandoned, a start-up fee of $65 will apply. You have 30 days to pick up your order. After 30 days your order may be disposed of.
We work with third-party printers that we trust and are affiliated with. In the rare case that there is a printing issue, we will work with the printers to get it resolved, but any costs incurred will not be at the expense of Agara Design.
Please note that some print materials may not show the exact same color that is showing up on your screen. This is due to the fact that each computer screen tint can be different. Any reprints required will not be at the expense of Agara Design. We recommend providing Hex #s or Pantone colors if you need exact shades matched up.
Final Artwork File Delivery
Final artwork files are emailed in a zip file. Please notify us if there is a special request.
All work, excluding print shop items, are subject to a 6% Maryland tax fee.
Contract Agara Design
By entering into a project with Agara Design, you are consenting to be bound by the terms of these policies and procedures. Links to our policies and procedures are posted on all our quotes and forms, as it is important to read them before beginning work.
Printing - Your approval to print your job is FINAL. It is your responsibility to ensure that there are no errors. What appears on the proof is what will be printed. If no proof is given, it is your responsibility to make sure you receive one. ANY oversights that require your job to be reprinted will be done at YOUR expense.
Artwork - Samples are for viewing purposes ONLY and are not to be used in any way unless agreed by Agara Design. Rights to artwork are NOT included with printing purchases unless otherwise agreed upon.
Performance Liability: Agara Design does not warrant that the functions supplied by designs or prints, consultation or advice, will be uninterrupted or error-free. The entire risk as to the quality and performance of the work or project is with client. In no event will Agara Design be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the reproduction of, or appearance of the design, even if Agara Design has been advised of the possibility of such damages.
NOTE: Please make sure you understand all of the above agreement. Should you have any questions or concerns regarding these terms, please contact us before advising us of acceptance.
Agara Design makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. Agara Design will not be held responsible for any and all damages resulting from products and/or services it supplies. Agara Design is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Agara Design responsible for any such loss or damage. Any claim against Agara Design shall be limited to the relevant fee(s) paid by the customer.
Turnaround - Printing production is Monday through Friday on most jobs. 2-5 is needed on paper items, 2-5 days on banners, 7-10 days on screen printing, 1-4 weeks on web designs, embroidery 6-10 days.
Delays: Illness, injury, or other events beyond Agara Design’s control, such as: fire, theft, computer failure, and Acts of God may result in a delay of unpredictable length.
Rush Orders - A job is considered a RUSH ORDER when requested sooner than the normal turnaround time of that particular job.
Rush Order Fee - An extra charge (at least $65) will be determined with accordance of the job.
Same Day Turnaround - Same day orders will be considered a RUSH ORDER and will incur a fee of no less than $100.
